5.1La Petite Suisse undertakes to provide quality services but cannot guarantee specific results in every situation. With regard to the work to be carried out, La Petite Suisse is bound by an obligation of means, not an obligation of result.
5.2The customer undertakes to ensure that every item has a care label or a care sheet. If not, La Petite Suisse accepts no liability for any defect.
5.3Any visible defect or missing item relating to the services provided must be reported to La Petite Suisse in writing and in detail immediately, and no later than 72 hours after delivery or collection from the shop. Complaints made after this period will not be accepted.
5.4If the customer has repairs or alterations carried out by others or carries them out themselves, they immediately lose any right to complain or to claim under the guarantee. The customer also loses the right to complain if the damage results from failure to follow professional standards and usual instructions, or from misuse of the textile.
5.5La Petite Suisse is not liable for objects left in or attached to the items treated, or for other accessories such as buttons, fasteners, buckles, jewellery, belts, trimmings, plastics, rubber, keys, pens, coins, banknotes, leather straps, etc. Any loss or damage relating to or caused by these objects will not be covered by La Petite Suisse.
5.6La Petite Suisse is not liable for pre-existing defects in or damage to items. Nor is it liable for weaknesses or defects inherent in the materials caused by heavy use, weather, storage, a manufacturing fault, etc.
5.7La Petite Suisse is not liable for damage or distortion where the customer has given their consent, verbally or in writing, to a member of the company's staff, for example for the treatment of a fragile item or a difficult stain.
5.8Where La Petite Suisse is found liable and has failed in its obligations, it undertakes to resolve the problem by offering to treat the item a second time, to repair it, or to pay financial compensation. For a lost or damaged item, compensation will be calculated in proportion to the value of the item, taking its age and wear into account. Compensation is limited to a maximum of 10 times the price paid for treating the item. For items charged by the kilo, the weight of the item will be used as the basis for calculating compensation.
5.9Where one part of a set is given for treatment (e.g. a two-piece suit), compensation will cover only the part damaged or lost and not the whole set.
5.10La Petite Suisse will be released from liability if the customer does not return the item for analysis within 7 days of notification.
5.11If La Petite Suisse and the customer cannot reach agreement on restoration, replacement or compensation, they may refer the matter only to the “CACET” Arbitration Commission. Referral to the Arbitration Commission must be made to the secretariat of the “CACET” Commission (Brusselsesteenweg 478, 1731 Zellik), using a special form and in accordance with the Commission's rules.
5.12La Petite Suisse holds professional liability insurance with a recognised insurer. This insurance may apply within the limits and conditions set out in the policy.
5.13La Petite Suisse cannot be held liable for any delay or failure to perform resulting from force majeure or an event beyond its control, such as strikes, lock-outs, fire, machine breakdown, flooding, severe weather, pandemic, disruption to transport or energy supply, or any other unforeseeable circumstance preventing the normal performance of the services. In such cases, performance of the obligations is suspended for as long as the event lasts.
