General conditions

1. Generalities

1.1. These general conditions apply to all offers, orders and agreements between La Blanchage de la Petite Suisse SA (hereinafter referred to as “Petite Suisse”), number 0412.988.881 whose head office is located at Chaussée de Boondael 386, 1050 Ixelles, and the customer.

1.2. The customer declares to have read the general conditions via the website or by having consulted a copy in store before any commercial relationship with La Petite Suisse and to accept them in their entirety. Any deviation from this rule can only be made in writing.

1.3. Little Switzerland reserves the right to update, modify or revise these terms and conditions at any time, without notice to customers. It is the customer's responsibility to regularly check any possible changes to the terms and conditions on the company's website.

1.4. Acceptance of these general conditions also implies that the customer renounces the application of its own general conditions.

1.5. These conditions apply to both individual customers (B2C) and professional customers (B2B). Where certain provisions apply only to consumers, this is specified.

2. Prices, quotes and orders

2.1. The prices applicable to orders are those in force at the time La Petite Suisse processes the laundry. The applicable prices will be communicated in writing by La Petite Suisse or will be available on request in store, by email or by telephone. No rights can be derived from apparent errors in composition, impression, diction, or writing in shared price lists.

2.2. The final cost of each order will be determined during the thorough inspection of the linen by La Petite Suisse. Variations compared to the initially announced price may occur depending on the service requested, the nature of the textiles to be treated, the actions necessary to guarantee quality treatment, possible repair work or a request for express delivery. The verification of the weight, for the laundry to be washed per kilo or the number of items, for the laundry by the piece will be established by La Petite Suisse. The amount intended to establish the invoice will be rounded up to the next kilo. The use of specific supports for laundry logistics (laundry bags, covers, baskets, rolls, etc.) may be invoiced separately.

2.3. Little Switzerland reserves the right to apply a minimum amount or quantity to an order, without additional notice, to cover administrative and operational costs associated with the services.

2.4. Little Switzerland also reserves the right to revise prices in the event of significant changes in market prices, materials used and/or wages, several times a year and without notice. In general, La Petite Suisse adapts prices annually and without notice according to the index of the Belgian Textile Care Federation (www.fbt-online.be).

2.5. Any quote from La Petite Suisse is valid for the period indicated on it. If no deadline is specified, the quotation is valid for 30 calendar days.

3. Payment

3.1. Payment for La Petite Suisse services, unless otherwise specified, is made in advance or when the documents are deposited. The list of available payment methods is available in store.

3.2. La Petite Suisse invoices are payable on the due date indicated on the invoice. If no due date is specified, invoices are payable no later than 30 days after the invoice date. Payment costs are borne solely by the customer.

3.3. In the event of non-payment of an invoice by the due date, default interest of 1% per month on the amount of the unpaid invoice is due ipso jure and without prior notice of default. Payments made by the customer to La Petite Suisse will mainly be charged to the oldest unpaid and overdue invoices. Billing is carried out first on the interest due, then on the costs due, and finally only on the principal due.

3.4. In the event of non-payment of an invoice by the due date, all other claims not yet due on the customer become due by operation of law and without prior notice of default. In this case, La Petite Suisse also reserves the right to suspend the execution of the service without prior notice and without compensation for the customer.

3.5. In the event of repeated failure to pay by the customer and if La Petite Suisse has goods from the latter, the customer grants La Petite Suisse an extended right of retention on his goods without prior notice and without compensation for the customer. Retention will be extended until full payment of the amounts due.

3.6. In the event of repeated impossibility of delivery or abandonment by the customer, the goods become the property of La Petite Suisse 12 months after their deposit and without compensation of any kind.

3.7. Should the legal personality of the contracting parties change for any reason, the agreement will continue to apply to the new legal entity. The same applies when a company is taken over or transferred. The customer who transfers the contract or who continues his activities in a company remains responsible for all obligations towards La Petite Suisse during the term of the contract. Changes in contact details, billing addresses, etc. must always be reported in writing to La Petite Suisse.

3.8. Any communication, notification or complaint can validly be made by email, as long as it comes from the official email address provided by the customer to La Petite Suisse.

4. Delivery and execution time

4.1. The delivery and execution times communicated by Little Switzerland are purely indicative but Little Switzerland is committed to respecting the deadlines communicated as best as possible. In the event of an abnormal delay (>3 weeks after the expiry of the indicative execution period initially planned), the customer has the right to cancel the contract or to contest the provision of the service in writing and without judicial intervention. In no case will a delivery deadline not respected result in a claim for damages from La Petite Suisse.

4.2. The Customer is required to inform La Petite Suisse of all useful data (among others, the layout of the premises, opening hours, specific accesses, etc.), as well as to provide adequate premises and equipment for the reception of linen.

4.3. Little Switzerland reserves the right to make partial deliveries. The partial delivery of the order cannot under any circumstances justify a refusal to pay for the goods delivered or a claim for damages.

5. Responsibility

5.1. Little Switzerland is committed to providing quality services but cannot guarantee specific results in all situations. Little Switzerland is bound by an obligation of means in terms of the work to be carried out and not to an obligation of result.

5.2. The customer undertakes to provide all items with a care label or a maintenance sheet. Otherwise, La Petite Suisse loses all responsibility in the event of a defect.

5.3. Any visible defect or missing item concerning the services provided must be reported in writing and in detail to La Petite Suisse immediately and at the latest 72 hours after delivery or collection in store. Claims filed after the expiry of this deadline will not be accepted.

5.4. If the customer has repairs or modifications carried out by others or by himself, he immediately loses any claim or warranty rights. The customer also loses his right to claim if the damage results from non-compliance with professional standards and usual instructions, as well as from the misuse of the textile.

5.5. Little Switzerland is not responsible for forgotten objects, attached to treated parts and other attached accessories such as buttons, clasps, buckles, jewelry, belts, fittings, plastics, rubber, keys, pens, coins, pens, coins, bills, pens, coins, bills, leather bands, etc. Any loss or damage related to these objects or caused by these objects will not be covered by La Petite Suisse.

5.7. Little Switzerland is not responsible for damage or deformations in the event that the customer has given his agreement orally or in writing to a member of the company's staff, for example for the treatment of a sensitive part or a delicate task.

5.8. In the event that La Petite Suisse is designated as responsible and has committed a breach, it undertakes to solve the problem by offering a second treatment of the part, a repair or by offering financial compensation. For a lost or damaged piece, compensation will be calculated in proportion to the value of this piece, taking into account its age. The amount of compensation will be limited to a maximum of 10 times the price paid for the treatment of the part. In the case of an item invoiced by the kilo, the weight of the piece will be used as the basis for calculating the compensation.

5.9. When part of a set is given to be treated (e.g. a 2-piece suit), compensation will only be paid for the damaged or lost part and not on the whole.

5.10. The responsibility of La Petite Suisse will be released if the customer does not return the item for analysis within 7 days of the notification.

5.11. If La Petite Suisse and the customer cannot reach an agreement on restoration, replacement or compensation, they can only appeal to the “CACET” Arbitration Commission. An appeal to the Arbitration Commission must be submitted to the secretariat of the “CACET” Commission (Brusselsesteenweg 478, 1731 Zellik) using a special form and in accordance with the Commission's regulations.

5.12. Little Switzerland is covered by professional liability insurance from a recognized company. This insurance may take place within the limits and conditions set by the policy.

5.13. Little Switzerland cannot be held responsible in the event of delay or non-performance resulting from a case of force majeure or an event beyond its control, such as a strike, lock-out, fire, machine failure, flood, bad weather, bad weather, bad weather, weather, pandemic, pandemic, pandemic, interruption of transport or energy, or any other unforeseeable circumstance preventing the normal performance of services. 6. Personal data protection (RGPD)

6.2. This data is used exclusively for order management, invoicing, delivery and, where applicable, for the sending of commercial information relating to La Petite Suisse's services.

6.3. The data is kept for the time necessary for the above purposes and legal obligations (accounting and fiscal).

6.4. The customer has the right to access, rectify, oppose, oppose, delete and portability of their data, which they can exercise by simple written request sent to La Petite Suisse (by post or email).

6.5. Little Switzerland never shares personal data with third parties, unless required to do so by law or if this is necessary for the correct execution of the service (e.g. logistics providers).

7. Independence of the clauses

If any provision (or part of it) of these terms and conditions is unenforceable or contrary to a mandatory law provision, this will not affect the validity and enforceability of the other contractual provisions. In such a case, the parties will negotiate in good faith to replace the unenforceable or contradictory provision with an enforceable and legally valid provision that comes as close as possible to the purpose and intent of the original provision.

8.2. Little Switzerland has no control over the content, privacy policies, or practices of these third party sites and therefore assumes no responsibility for their use.

9. Applicable law

9.1. Belgian law is applicable to these general conditions.

9.2. Disputes arising from the application of the general conditions will be submitted exclusively to the courts of Brussels, unless otherwise provided for by law.
